Mr. Richardson first achieved success in the field of employment law, and he continues to represent employers in this field. His clients in this area fall into two categories: those with whom he interacts regularly to provide counsel and advice on multiple small matters and those who wait to contact him until a matter has mushroomed into a crisis. Although Mr. Richardson finds forward-looking collaboration to be the most rewarding aspect of his practice, he has enjoyed considerable success helping employers regain control over runaway disputes.
Mr. Richardson handles all aspects of employment law and drafts handbooks, policies, and procedures, as well as employment contracts and associated limitations on competition, solicitation, and disclosure. He also coordinates various investigations and audits legal compliance. Finally, he represents his clients in all forms of employment litigation, whether waged in the courts or before state and federal agencies such as the Equal Employment Opportunity Commission.
The relationships Mr. Richardson develops with the owners and managers of the businesses he represents in employment matters often prompt requests for him to handle other business matters. As a result, Mr. Richardson has developed a wealth of experience in business law and routinely represents companies in transactions of varying complexity. These matters may be internal in nature, such as the amendment of corporate documents, issuance of new stock, or the formation of a subsidiary. Alternatively, the transaction may involve third-parties, such as negotiation for the sale or acquisition of a business or a particular asset. Additionally, Mr. Richardson is well-versed in the formation of legally effective business documents employed to limit liability, such as limited warranties and disclaimers, and evaluates advertising and other business communications for legal compliance.
Mr. Richardson also stands out from other attorneys who practice business law because he represents his clients in litigation. He has represented clients in trials and appeals in state and federal courts, including the Virginia Supreme Court and the United States Supreme Court. Mr. Richardson applies the same “out of the box” perspective to litigation as he does to advising clients. His creative approach has often enabled him to prevail in cases where others predicted failure and, where appropriate, to devise “win-win” resolutions which enabled one-time adversaries to find common ground.
Because of Mr. Richardson’s enthusiasm for handling all aspects of a client’s legal work, Mr. Richardson serves as general counsel to clients of all different sizes and types. Mr. Richardson participates actively in the client’s formulation of business strategy, identifies and vets various options, and consults to assure their implementation does not create new risks. As general counsel, he is available to provide input on every business matter which has legal implications.
In addition to serving as general counsel to for-profit businesses, Mr. Richardson has a special “niche” as counsel to non-profit organizations. These organizations face unique challenges which arise from the modern intersection between charitable ideals and business principles followed by successful charities. Mr. Richardson is adept at helping organizations to balance these intricacies and to develop modes of operation and governance which comply with the law, establish a clear hierarchy among various officers, and pay appropriate respect to the wishes of other stakeholders.
In each area of his practice, Mr. Richardson strives to form close working relationships with his clients. He prefers informal, direct, and free-ranging communication over self-promoting bluster which conveys no sense of shared purpose. Instead, Mr. Richardson strives to gather as much insight into his client’s goals, interests, and concerns as he can so his recommendations do not arise simply from legal considerations.
